3. Equipment Setup, Space, and Operational Requirements

Time allocation. Capture The Vibe requires a minimum of sixty (60) minutes for equipment setup and thirty (30) minutes for equipment pack-down. This time is separate from the operational hire hours.

Space requirements. The client must ensure the venue provides a clear, level, and stable floor space measuring at least 3m × 3m.

Power supply. The client must guarantee access to a safe, continuous, and standard 240V main power outlet within 5 metres of the setup location.

4. Mandatory Security Bond

Bond requirement. A fully refundable security bond of $300.00 AUD is mandatory for all hire packages and must be paid alongside the final balance.

Bond assessment and return. The security bond will be audited and returned to the client's nominated bank account within forty-eight (48) hours following the conclusion of the event, subject to the equipment being collected in an undamaged, clean, and fully operational condition.

5. Equipment Care, Prohibited Items, and Special Cleaning Fees

Liquid-free zone. The photo booth contains highly sensitive commercial digital and electronic components. Strictly no food, drinks, or liquids are permitted in the photo booth, or within the direct proximity of backdrops or media enclosures.

Liquid spill penalty. If the equipment, internal housings, printer stands, decorative enclosures, or backdrops are returned with any evidence of liquid spills, sticky alcohol residue, or beverage stains, a flat $150.00 AUD professional deep-cleaning and restocking fee will be automatically deducted from the client's security bond.

6. Client Liability, Property Damage, and Consequential Financial Loss

Full duty of care. The client assumes complete legal and financial liability for the safety, supervision, and protection of all Capture The Vibe equipment from the moment installation is complete until it is officially collected by our team.

Damage caused by guests. The client is fully liable for any physical damage, electronic failure, cosmetic defects, or theft caused to the equipment or props by event guests, patrons, or venue staff.

Liability exceeding the bond. If physical destruction, water ingress, or equipment damage exceeds the value of the $300.00 AUD security bond, the client remains financially liable for 100% of the total remaining balance required to repair or replace the equipment. The client must agree to settle any such commercial repair invoices within seven (7) days of issuance.

Consequential economic loss. If the client's event guests or patrons cause damage that renders the photo booth completely inoperable for a subsequent, pre-booked event, the client shall be held legally liable to indemnify Capture The Vibe for all consequential financial losses, including lost business revenue and contract refunds suffered while the equipment is out of service.

Right of termination (on-site attendants). If an attendant is present and deems guest behaviour to be aggressive, dangerously intoxicated, or posing an imminent threat to the safety of staff or equipment, Capture The Vibe reserves the right to terminate the service and pack up the booth immediately. No refunds or partial adjustments will be issued under these circumstances.

7. Unattended Hire and Delivery Acceptance

Verification of condition. For unattended hires, the client or an authorized venue representative must inspect the photo booth setup immediately upon installation. By accepting delivery and permitting our team to leave the premises, the client legally verifies that the equipment has been delivered in flawless operational and aesthetic order.

Prohibition of movement. Once installed and positioned by our team, the photo booth, stands, backdrops, and power leads must not be moved, disassembled, unplugged, or altered by the client or event guests under any circumstances.

8. Imagery and Intellectual Property Rights

Promotional material rights. Capture The Vibe reserves the right to use any digital images, collages, or media captures generated by the photo booth during the event for commercial promotional purposes, including social media platforms, websites, and print marketing. Any other photos taken during the event through other mediums must receive verbal consent from all people in the photo to the attending Capture The Vibe staff member to be used for promotional purposes including social media platforms, websites and print marketing, except for when the people in the photo are under eighteen (18) years of age, whereby permission to publish must be acquired from the legal parent/guardian of the subject within the media capture or image as well as the person within the image.

Client opt-out. If the client does not wish for event media to be used publicly, they must explicitly notify Capture The Vibe in writing prior to the commencement of the event.

Media delivery. All digital galleries and event photo links will be processed and delivered to the client within five (5) business days following the event.

9. Force Majeure

Exclusion of liability. Capture The Vibe shall not be held legally liable or responsible for any failure or delay in performing its contractual obligations if such failure arises from causes entirely beyond its reasonable control, including but not limited to: severe weather events, natural disasters, localized power grid failures, government mandates, or medical emergencies. In such instances, Capture The Vibe will make every reasonable effort to offer a free reschedule within a 12-month period.

10. Governing Law

Jurisdiction. These Terms and Conditions are strictly governed by, interpreted, and enforced in accordance with the laws of New South Wales (NSW), Australia. Any formal legal claims, tribunal applications (NCAT), or disputes must be filed within the jurisdiction of New South Wales courts.
